Practical Law Commercial has released a new Legal update, Amended Modern Slavery Act 2018 (NSW) commences 1 January 2022. The Modern Slavery Amendment Act 2021 (NSW) (NSW Amendment Act) commenced on 29 November 2021 and introduces a number of key changes to the Modern Slavery Act 2018 (NSW) (NSW Act), including:
- Repealing reporting requirements for commercial organisations.
- Repealing provisions enabling courts to make certain post-conviction orders relating to modern slavery offences.
- Providing the Anti-slavery Commissioner with a much broader spectrum of functions and powers, including the ability to work and consult with other agencies.
- Introducing requirements for certain state-owned corporations and local councils to comply with the modern slavery provisions in the Modern Slavery Act 2018 (Cth) (MSA).
- Providing for recognition payments to certain victims of modern slavery.
